Terms of Use

1. Who we are and what these terms cover

Kinetic Takeover Education is the digital education and course-commerce platform operated by Kinetic Takeover LLC, a Wisconsin limited liability company ("Kinetic Takeover", "we", "us", "our"), with a mailing address at 460 E Veterans Way, Unit 6, Mukwonago, WI 53149, United States. These Terms of Use govern your access to and use of this website, your student account, and any course, program, test-preparation product, quiz, question bank or downloadable resource you purchase or access through it (together, the "Services"). By creating an account or purchasing a product you agree to these terms. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be able to form a binding contract to purchase a product, and you must provide accurate account information. You are responsible for everything that happens under your account. Keep your password confidential, use a password you do not reuse elsewhere, and notify us promptly if you believe your account has been accessed without your permission. We may suspend or terminate an account that is used in breach of these terms.

3. Accounts are personal — no sharing

A student account is licensed to one individual. You may not share your login credentials, sell or transfer your account, or allow another person to use your access to view purchased content. We may treat indicators of shared use — such as concurrent sessions from unrelated locations or unusual access patterns — as a breach and suspend access without refund.

4. Purchases, pricing and access

All products are sold as one-time purchases; we do not currently offer subscriptions or recurring billing. Prices are shown in US dollars on each product page and may change at any time, though a change never affects a purchase already completed. Access to a paid product is granted only after our payment provider confirms your payment, and the access period — lifetime or time-limited — is stated on the product page. We may update, improve, reorganise or retire course content over time; we do not guarantee that any specific lesson, question or feature will remain available indefinitely.

5. Payment processing

Payments are processed by Stripe. We do not receive or store your full card number, security code or bank credentials. Your use of the payment form is also subject to Stripe's own terms and privacy policy. If a payment is reversed, disputed or charged back, we may suspend or revoke access to the affected product.

6. Refunds

Our products are digital and are made available immediately after purchase. Refund eligibility and how to request a refund are described in our Refund Policy, which forms part of these terms.

7. Intellectual property

All course materials, videos, written lessons, question banks, practice exams, explanations, workbooks, downloads, graphics, branding and software on the platform are owned by Kinetic Takeover or by our content partners and are protected by copyright and other laws. Nothing in these terms transfers ownership to you.

8. Your licence to use the content

On purchase, and for the access period stated on the product page, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view and use the content for your own study. You may download materials that are expressly offered as downloads and print them for your personal use only.

9. Prohibited uses

You may not, directly or through anyone else: copy, reproduce, record, screenshot in bulk, transcribe, scrape, crawl, harvest, mirror or otherwise extract course lessons, questions, answers or explanations; republish, redistribute, share, resell, sublicense, rent or commercially exploit any part of the content; use automated tools, scripts, bots or headless browsers against the site or its API; attempt to access questions, answers, other users' data or administrative functions you are not entitled to; probe, scan, overload or interfere with the security or integrity of the platform; or use the content to build, train or populate a competing product, question bank or dataset, including for machine-learning purposes. Breach of this section may result in immediate termination without refund and legal action.

10. Progress, quiz data and results

The platform records your lesson progress, quiz attempts, answers and performance analytics so it can show your history and highlight weak areas. This data is a study aid only. Practice scores are not predictive of, and do not guarantee, any particular result on an official examination or certification.

11. Test-preparation products

Our test-preparation products are independent study tools. They are not official, not government-issued, and not approved, endorsed or sponsored by any government agency, licensing body or examination authority. 12. Affiliates and referrals

The platform supports referral links and affiliate commissions. If you participate as an affiliate or content partner, you may not use spam, paid search on our brand terms, misleading claims, self-referral, cookie stuffing or any other deceptive practice to generate referrals. Commissions arising from such activity may be withheld or reversed, and commissions attached to refunded orders are reversed. Referral attribution is recorded server-side and our records are authoritative.

13. Support and requests

You can contact us through the support and request tools in your account area for help with access, refunds, or deletion of your account and data. We aim to respond to requests within a reasonable time.

14. Termination

You may stop using the Services and request deletion of your account at any time. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if your payment is reversed. Sections covering intellectual property, prohibited uses, disclaimers and limitation of liability survive termination.

15. Disclaimers and limitation of liability

The Services are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the content is error-free, complete, current with every change in law or examination content, or that access will be uninterrupted. To the fullest extent permitted by law, our total liability arising out of or relating to the Services is limited to the amount you paid us for the product giving rise to the claim, and we are not liable for indirect, incidental, special or consequential damages, or for lost profits, missed examinations or lost opportunities. Nothing in these terms limits liability that cannot lawfully be limited.

16. Changes to these terms

We may update these terms as the platform evolves. The version published on this page is the current one, and material changes take effect when posted. Continuing to use the Services after a change means you accept the updated terms.

17. Governing law

These terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Wisconsin have jurisdiction, and you consent to venue there, except where the consumer law that applies to you gives you a non-waivable right to bring proceedings elsewhere.
